PURINA - Tux National Promotion
Terms and Conditions:
1. Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
2. Entry is open to residents of New Zealand who are 18 years or over, (“Eligible Entrant”). Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
3. The promotion commences Monday 3rd May 2010 & closes at 5pm on Wednesday 30th June 2010 for in-store entries or by last mail received on that date for mail entries (“Promotion Period”).
4. To enter, purchase any 40kg bag of TUX Energy or TUX Country (“Promotion Product”) from a participating rural store where the promotion poster is displayed. Complete the entry form and attach an original barcode from the TUX product OR the till receipt and:
a. In-store - drop the completed entry in the entry box found in the participating store; OR
b. Mail to - “TUX National Promotion”, Freepost 195372, Response Bag 500147, Auckland (Note a postage stamp is not required for mail entry.)
5. One entry per purchase is permitted, provided each entry is made using a separate entry form with a till receipt OR product barcode attached, (ie. multiple purchases require separate till receipts and each till receipt OR product barcode must be attached to a completed entry form).
6. The Promoter reserves the right to require any entrant to provide their proof of purchase for every entry they made during the Promotion Period in order to claim a prize.
7. The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to making multiple entries that are not associated with the separate purchase of a Promotion Product, or for submitting an entry which is not in accordance with these conditions of entry.
8. All valid entries received during the Promotion Period will be entered in the prize draw.
9. The following prizes will be awarded:
a. Major prize includes:
i. a Nissan Navara ST Double Cab 4x4 valued at $52,450 recommended retail price (“RRP”). The vehicle includes registration, 3rd party insurance and on-road costs. Colour choice will be subject to availability at the time the prize is claimed. Any additional costs including comprehensive insurance and additional optional extras are the responsibility of the winner; and
ii. a CSB Huntsman Dorado 5.5m outboard family cabin powerboat with trailer valued at $55,958.00 RRP. The boat includes registration and on-road costs. Colour of the boat is white. Any additional costs including insurance and additional optional extras are the responsibility of the winner.
b. Minor prize is a POWERBUILT Mechanics Set valued at $199 RRP. There 20 minor prizes to be awarded.
10. The prize draw will be conducted at 11am on Friday 9th July 2010 at the offices of the Promoter in Auckland. The first valid entry drawn will win the major prize and the next 20 valid entries drawn will each win a minor prize.
11. All winners will be notified by telephone. The names and towns of each winner will appear at www.purina.co.nz
12. Prizes are not transferable & cannot be taken as cash, unless otherwise stipulated.
13. Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes.
14. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
15. Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed by visiting www.nestle.co.nz or calling 0800 830 840.
16. Promoter’s decision is final and no correspondence will be entered into.
17. In the event that the major prize cannot be legally awarded to a winner, the winner may nominate a person to whom the prize can be legally awarded and delivered in accordance with these terms and conditions. The Promoter will award the prize to the nominated recipient in place of the winner, provided that the winner and the nominated recipient sign any document required for this purpose by the Promoter.
18. Each prize winner should look to the manufacturer of products and provider of services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Consumer Guarantees Act 1993 [NZ]) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
19. In the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within New Zealand, the Promoter reserves the right to substitute a different prize item of equal or greater value.
20. By entering the competition, the major prize winner agrees that the Promoter may use their name, image and photograph/s for publicity and promotion purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s.
21. Prizes will only be delivered in New Zealand and each winner should allow 28 days from the prize draw for delivery of their prize.
